So if you’re considering building a duplex on your property, you’re in luck. In 2020, the New South Wales Government delivered the Low Rise Housing Diversity Code (formerly the Low Rise Medium Density Housing Code). Under this revised code, this allows well-designed duplex developments to be undertaken under a fast-tracked Complying Development Approval

This was undertaken to provide alternative housing types to traditional freestanding houses, and provide more choice for consumers.

We set the groundwork

With the revised rules for the Low Rise Housing Diversity Code 2020, getting approval to build your duplex has been made easier. But it doesn’t mean it’s not involved. So at CIVAC, we work with you to take the headache out of managing your application process.

To set the groundwork, the first step is to talk to us about your project. We can help you identify the potential impacts, benefits, and challenges you may face. We also help map out the risks, and ensure you understand all the necessary approvals and certificates required for your new duplex build. We then map out a way forward.

We gather the necessary documentation

While the process for acquiring a Complying Development Certificate (CDC) for your duplex is shorter than the typical Development Application, there are still a number of documents that you’ll need to gather first.

Your CIVAC Project Manager will help you gather the necessary supporting documentation to lodge your CDC, which includes:

A set of plans and specifications for your duplex
A site plan of your property
Elevations showing the side views of the proposed works. This includes any cutting or filling
A list of building specifications, including building materials and construction methods
Any letters of consent for proposed works, such as retaining walls
A complying Waste Management Plan
A complying Stormwater Management Plan
BASIX certificate

We lodge your application

Once your Project Manager has collected all the required certificates and supporting documentation, their next step is to prepare and lodge your CDC to a Private Certifier.

Our aim here is to take the hassle out of your application process. So, we take care of the entire process for you, and lodge your CDC on your behalf.

At this point, there’s nothing for you to do but sit back, relax, and wait for us to contact you. Your Project Manager will liaise with a Private Certifier to monitor the progress of your CDC. They’ll provide you with regular updates, and remain on call to answer any questions the Council may have about your application, and be the ones to respond to Council with any further information.

The next steps

Your Project Manager will notify you once your CDC receives approval. Once this occurs, they’ll then keep the process moving, and work with the Private Certifier to obtain a Notice to Commence. This Notice essentially shows proof that you’ve made all necessary payments to your local Council, and that all the required licences and certifications have been acquired.

Now, you’re ready to start building. We can help you choose a builder from our trusted panel of licenced specialists, so you can connect with the team that’s right for your project.

Comprehensive advice to achieve approval for your duplex

If you’re considering building a duplex on your property, it’s important to ensure that it meets the right building standards. After all, just because it’s been fast-tracked, doesn’t mean there aren’t rules governing the build.

Your new duplex construction must meet the following criteria:

Your property must be located in an R2, R3, R4, or B1 zoned areaYour block must meet all current length, width, and square metre requirements as stated by your local Council
Your construction must meet specific Council dimensions
In some cases, Councils have specific rules regarding duplex setback from property boundaries. We can check these for you
Each dwelling must face a public road
Neither dwelling must be located behind another dwelling, unless it’s on a corner block
Each dwelling must have at least one off-street parking spot available
